About these terms
These terms apply to your use of worklyup.com in every language (“the site”). By using the site, you accept them; if you do not agree, please do not use it.
The site is operated by Workly Up Ltd, a company registered in England and Wales under company number 14413111, with its registered office at 71-75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom. You can contact us at info@worklyup.com.
Our privacy policy and cookie policy explain how we handle personal data and cookies. Worklyup Social, our private social media publishing tool, has its own terms of service.
Client work is governed separately
The site describes our studio and services; it is not an offer to provide them. Every engagement, including audits, sprints, projects and retainers, is governed by the proposal, statement of work or agreement we sign with the client. If anything on the site differs from a signed document, the signed document applies.
Descriptions of services, packages, processes and typical timelines are general information. Scope, deliverables, fees and dates are fixed only in a signed proposal or agreement. Information on the site is not legal, tax or financial advice. Where we mention matters such as company formation, these are handled by our regulated partners under their own terms.
Using the site
You may use the site to learn about Workly Up and to contact us. You must not:
- use the site in any way that breaks the law, or for fraudulent or harmful purposes;
- send spam, false enquiries or malicious code through our forms;
- try to get around or interfere with our security, including the Cloudflare checks on our forms;
- try to gain unauthorised access to the site, the server it runs on, or any connected system;
- copy large parts of the site by automated means in a way that burdens it or breaks these terms, apart from ordinary indexing by search engines.
Introducing viruses or attacking the site may be a criminal offence under the Computer Misuse Act 1990. We may report it to the authorities and cooperate with them, including by sharing information about the person responsible.
We may change, suspend or withdraw any part of the site without notice. We do not promise that the site will always be available or free from errors.
Our content and trade marks
The site’s text, design, graphics, photography, code and the Workly Up name and marks belong to Workly Up Ltd or to people who have licensed them to us. They are protected by copyright, trade mark and other laws.
You may view the site, print or save pages for your own reference, and share links to it. You may not reproduce, adapt, sell or otherwise use our content commercially without our written permission. Please do not use our name or marks in a way that suggests a connection with us.
Work we show for clients remains subject to the rights of those clients, and we show it with their permission. Client names, logos and the trade marks of platforms we work with, such as Shopify and Meta, belong to their owners. We name a partner status only where we hold it. Concept work is labelled “Concept · Self-initiated”, images made with AI tools are labelled “AI-assisted”, and interface illustrations made for fictional brands are never presented as client work.
What you send us
When you send an enquiry or application, please make sure the information is accurate and that you are entitled to share it. Do not send confidential information through the forms; if confidentiality matters, we can sign a non-disclosure agreement first. Sending an enquiry does not create a client relationship or any obligation on either side.
Links
Links to other websites are provided for convenience. We do not control those sites and are not responsible for their content or how they handle your data.
You may link to our home page or any other page, as long as you do so fairly and lawfully, and not in a way that suggests a partnership or endorsement that does not exist. We may ask you to remove a link at any time.
Our liability
We take care to keep the site accurate, but its content is provided for general information and may not always be complete or current. To the extent the law allows, we exclude all implied conditions, warranties and representations about it.
If you use the site for business purposes, we are not liable for any loss of profit, sales, business, revenue, anticipated savings, business opportunity, goodwill or reputation, for business interruption, or for any indirect or consequential loss arising from your use of the site or reliance on its content.
If you are a consumer, we provide the site for your private use and are not liable to you for business losses. We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded under the law of England and Wales.
Changes to these terms
We may update these terms from time to time. The date at the top shows the current version, and the version on the site when you use it applies to that use.
Governing law
These terms, and any dispute or claim arising from them or from your use of the site, are governed by the law of England and Wales.
If you are a business, the courts of England and Wales have exclusive jurisdiction. If you are a consumer, you may bring proceedings in England and Wales or in the part of the UK where you live; if you live outside the UK, you keep the protection of any mandatory consumer laws of your country of residence.
